In July 2024, Level Up experienced a cybersecurity incident (the “Data
Incident”). On June 16, 2025, the Plaintiff filed a Class Action Complaint
against the Defendant in the Circuit Court of the Fifteenth Judicial Circuit,
Palm Beach County of Florida, relating to the Data Incident affecting Defendant.
The Complaint asserts several causes of action. Level Up denies the allegations
and all liability with respect to any and all facts and claims alleged in the
Action.
